Terms of service

Business Concierge: Legal Assist and Tech Assist (the “Services”) are provided by Lifestyle Services Group Limited trading as Assurant and are available to all customers who purchase a Business Concierge: Legal and Tech Assist bundle from the Assurant Payment Website. All customers must be aged 18 or older. Lifestyle Services Group Limited is a company registered in England (Company No: 5114385) mailing address of Emerald Buildings, Westmere Drive, Crewe, CW1 6UN. We reserve the right to suspend or remove User’s access to the Services, the grounds on which we can do this are explained below. You agree that the information you provide upon registration for the Services and at all other times will be true, accurate, current and complete.

Definitions


Words and expressions that have a particular meaning in these Terms of Use are defined in this section and have the same meaning wherever they appear.

• “Service” or “Services” – Business Concierge: Legal and Tech Assist

• “Helpline” – The Helpline available to you as part of the Service, (Monday – Friday 9am-5pm excluding Bank Holidays).

• “Our” “Us” or “We” – Lifestyle Services Group Limited trading as Assurant

• “Customer Website” – The website (coop.business-concierge.online) which you access to set up your regular monthly payment and register for the Services,, which is provided by Business Stack on behalf of Assurant. Business Stack is the trading name of The Legal Marketing Innovation Company Limited, our provider of Legal Assist services.

• “Tech Assist” – Through our Tech Assist product, you can access over the phone support to help you resolve issues with your connected devices (mobile phones, tablets, laptops, printers and more). Our tech assist agents will support you by providing troubleshooting methods which help resolve technical issues. Telephone support opening hours are detailed under the “Tech Assist Opening Hours” header below.

• “Legal Assist” – Through our legal assist product, you can access over the phone support from our Legal Advisors who are specialist in all facets of commercial and corporate law. Telephone support opening hours are detailed under the “Scope of the Service – Legal Assist” header below.

Benefits of Business Concierge: Legal and Tech Assist

Legal Assist

Our legal assist product is supported by our select panel of legal advisors who are well positioned to advise you on commercial and corporate law. The scale and variety of skill sets held by our legal panel enables us to find the right advisor to suit your needs, as well as providing a range of tools and resources to help you run your business. This benefit includes:

• Access to legal advisors who are specialist in all facets of commercial and corporate law.

• Free initial consultation(s) with a trained advisor and a discounted rate of at least 10% on advisor’s fee if you decide to instruct the advisor to act for you.

• A legal document health check to ensure you have the right policies, procedures and documents in place, plus, access to a complimentary suite of commercial document templates e.g. Contract of Employment and Property Lease Contract.

Tech Assist

Our Tech Assist product provides you with over the phone support which can be accessed should you encounter technical difficulties with your connected devices (Mobile Phones, Tablets, Laptops, Desktops and more). This product is designed to provide you with a service which assists you in resolving technical challenges which can be resolved remotely. The product does not offer a repair service for connected device products whereby functionality cannot be restored remotely by the Tech Assist Agent and yourself over the phone. The Tech Assist Agent may however advise you over the phone to seek further technical assistance if they are unable to resolve the particular issue.

How to Set Up and Use the Benefits


As a customer of Business Concierge, you will be sent a Welcome SMS & Email which will contain a link to the Business Concierge Website (for registration and payment), a link to coop.business-concierge.online & details of the helpline number for Tech Assist. Visit the Customer Website and input your email address and postcode to sign in and add your payment details. Once logged in, you can access the Legal Assist & Tech Assist tabs which gives you access to; Legal document health check, a suite of commercial document templates and the helpline number for expert technical support.

Terms of Use

• Legal Assist is arranged by Assurant and sourced by Business Stack.

• Tech Assist is provided by Assurant.

These Terms of Use apply to your use of Business Concierge (the “Service”). Before you register for the Service, please carefully read the Terms of Use. By using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms of Use, including any future modification to these Terms of Use. In addition to these Terms of Use, when you access Business Concierge your usage will also be subject to the terms of use, acceptable use and privacy policies for the Website. By using the Service and accessing the Service, you agree to be bound by those terms and conditions as well as these Terms of Use. We will notify you of any significant changes, for more information please see below (See section 5 – Changes to these Terms of Use).

I. Business Concierge Eligibility

To be eligible for Business Concierge you must:

• Be aged 18 years or older

• Have purchased and maintained your payments for a Business Concierge bundle via Our customer registration and payment services website

We reserve the right to suspend or remove user’s access to the Service, the grounds on which we can do this are explained below.

II. Scope of the Service – Legal Assist

Business Concierge allows you to access the Customer Website and the Legal Helpline which is arranged by Assurant and sourced by Business Stack and gives you;

a) Access to specialist legal advisors

b) Free initial consultations with a legal advisor to help you decide if they are right for you

c) Discounts to advisors usual charging rates if you decide to instruct the advisor after your initial consultation

d) Templates of some common business contracts.

Access to the free Helpline providing free legal consultation(s) can be accessed between the hours of 9:00 - 17:00, Monday to Friday, excluding Bank Holidays. To request a free consultation, you can either, fill out the enquiry form on coop.business-concierge.online or by calling our legal Helpline (numbers for which can be found on the Web link above).

Whether your request is by enquiry form or Helpline, We will arrange with you to speak to an advisor. If, when you call, a specialist is available at the time We may arrange for you to speak with them straight away, however, this will not always be possible. Free consultations are only available on singular case/topic basis.

If any additional requests are made for free consultations regarding a subject which you have already received a free initial consultation for, such requests may be rejected.

Following your free initial consultation, if you choose to instruct the legal advisor, they will send you separate terms of engagement, upon which you will engage and contract directly with the legal firm to provide specific engaged legal services at a discounted rate.

III. Scope of the Service – Tech Assist

Tech Assist allows you unlimited access to over-the-phone technical support for all of your connected devices in your office and home, such as connectivity, Bluetooth ®, WI-FI, setup and installation, help with setting up your new device and installing new software and apps.

Support can be provided for you mobile phone, tablets, printers and other connected devices.

Opening hours for technical support can be found below.

In the event that the fault is through services provided by a third party e.g. network, broadband or electricity supplier, we will be unable to support the problem until such services have been restored.

The product does not offer a repair service for connected device products whereby functionality cannot be restored remotely by the Tech Assist Agent and yourself over the phone.

Tech Assist can be used an unlimited amount of times and Use is via telephony only.

1. Important information about using the Service

1.1. The specialist legal advisors are solely those who have a relationship with Business Stack to provide this Service to you.

You are under no obligation to use any of these advisors or use this Service.

There may be other firms or advisors who may be more appropriate or suitable to for you.

Our responsibility to you is limited to using reasonable skill and care to select reputable firms and advisors using the specialist skills of Business Stack.

1.2. Please ensure that all information you provide in the course of using the Service is correct, complete, accurate and not misleading and that you provide all relevant facts.

It is your responsibility to check that any information, content, material or data you have provided whilst using this Service meets the criteria and that any information that the firm holds about you is correct.

Failure to provide accurate information, disclose all relevant facts or correct mistakes or errors in the information the firm holds about you could invalidate the advice provided to you.

Business Stack do not accept responsibility or liability for any loss or damage you may suffer or incur if any information, content, material or data you provide is not correct, complete and accurate or if it is misleading, or you fail to disclose all the relevant facts.

1.3. If you choose to instruct a legal advisor following your initial free telephone consultation, they will send you separate terms of engagement upon which you will deal with them directly.

Once you have accepted their terms of engagement, any advice, or assistance provided to you will be subject to those terms and you will be solely liable for any fees resulting from instructing the advisor to act for you.

1.4. If you are providing information about someone other than yourself, you must get permission to use this information before providing it to Business Stack.

By submitting any details on another person, you are confirming that you have their permission to do so and that they understand how their information is to be used.

2. Important information about using the Customer Website

2.1. All access to the Website is governed by the terms of use, acceptable use and privacy policies for the Website.

The Website terms set out the basis on which you can use the Website together with any prohibitions or restrictions on use or access.

2.2. You are responsible for all activities that occur under your login on the Website.

You must notify Business Stack immediately of any unauthorised use of your login details.

2.3. None of the material on the Website constitutes personal legal advice – it is for guidance only.

Please ensure that either you seek legal advice through accessing legal advisors as part of the Service or independently before you rely on any guidance to check that it is appropriate to your specific circumstances and meets your requirements.

All legal materials on the Website is stated as being based on English, Scottish or Northern Irish law (as applicable).

Please ensure that you review the correct guidance based on the law to apply to your specific situation.

2.4. The download and use of free legal templates from the Website do not constitute legal advice.

Any template will need to be carefully considered and tailored to reflect your business needs and requirements, Business Stack make no representation and give no warranty with respect to the suitability of the template to your specific needs.

You should seek legal advice before relying on a template.

2.5. All templates are provided as part of the Service and are for your use only; they must not be resold or supplied to any third party.

Use of the templates by a third party will constitute as infringement of the intellectual property of Business Stack and may be actionable by them against you.

2.6. The templates will be periodically updated to reflect changes in the law, however, Business Stack cannot guarantee that any template or information guide is completely up to date with the law at the time you use it.

Each document will be clearly labelled with the date with which it was last updated.

The only warranty that Business Stack provide, is that the document provided reflects the current law at the time of last update by Business Stack.

3. Fees, Cancellations and Refunds

Fees

3.1. As you have purchased Business Concierge, you will need to pay a fee to Us for the Services, via Our Website.

The fee amount and duration of the Services and payments will be explained to you at the time you select the Business Concierge bundle.

Upon subscribing to the service, you waive the right at a cancellation period and full payment is due, as You will have instant access to the service which contains downloadable content, curated articles aimed to help your business and helplines for Legal Assist and Tech Assist services.

Cancellations, terminations, suspensions and refunds

3.2. You can cancel the Service at any time by selecting ‘Cancel’ through your account on the Customer Website.

3.3. We may suspend, terminate, cancel or refuse you access to the Service where:

• We may cancel Our agreement with you for the provision of the Services, provided that We give you at least 30 days’ notice of the cancellation. We may do this where;

o We believe it is necessary to ensure that safety and security of your or other customers’ personal information;

o We believe you haven’t made the agreed payment for the Services;

o We believe it is necessary to prevent a crime or fraud, or where required by law; or

o We believe you breached these Terms or Use or the Customer Website Terms.

3.4. We will also suspend access to the Website from time to time to allow Us to conduct regular maintenance.

3.5. Where We exercise our rights of suspension, termination or refusal lawfully and in accordance with these Terms of Use, We will not be liable to you or any third party for the termination, refusal or suspension, nor are We obligated to reimburse you for any payments made (if any).

These remedies are in addition to any other remedies We may have at law or inequity.

3.6. When your Business Concierge Service is cancelled or terminated, We will send you confirmation of cancellation or termination within 72 hours by either text message or email.

4. Limitation of Liability

4.1. Nothing in these Terms of Use excludes or limits in any way our liability to you where it would be unlawful to do so.

This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and fraud or fraudulent misrepresentation.

4.2. The Website is provided on an "as is" and "as available" basis without any representation or endorsement made and We make no warranties, whether express or implied, in relation to either the Customer Website or its use.

You acknowledge that We cannot guarantee and cannot be responsible for the security or privacy of the Customer Website and any information provided by you. You must bear the risk associated with the use of the Internet.

4.3. Subject to paragraph 4.1 above, our liability to you is limited to Us performing our obligations under these Terms of Use with reasonable skill and care and our total liability to you for the provision of the Services is £1,000.

Nothing on the Customer Website shall be deemed to constitute legal advice, recommendation or endorsement by Us of any of the law firms referred to or any of the services offered on our site. In no event will We be liable for:

(a) any indirect, special, punitive, exemplary or consequential losses or damages of whatever kind arising out of your use or access to the Services , including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise;

(b) any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile device as a result of the use of the Services ; or

(c) any failure to perform Our obligations hereunder where such failure results from any cause beyond Our reasonable control including, without limitation, mechanical, electronic or communications failure or degradation

(d) any loss or damage you may suffer or incur in connection with any services you obtain after using the Customer Website and instructing a legal advisor directly or for any acts, omissions, errors or defaults of any law firm in connection with that service.

Legal Assist is not provided by Us but is instead provided by third parties over whom We do not have control.

It is your responsibility to satisfy yourself that you wish to obtain any engaged legal services before doing so.

4.4. Any views, opinions, advice or assistance which is given or provided to you by a third party after you have used the Customer Website do not represent Our views, opinions, advice or assistance and are not checked, monitored, reviewed, verified or endorsed by Us.

We do not endorse, recommend or take responsibility for any third party who provides you with any views, opinions, advice or assistance.

You act or refrain from acting on any third party's views, opinions, advice or assistance at your sole risk and sole discretion and you are solely responsible for any decision to act or refrain from acting on such views, opinions, advice or assistance.

We are not responsible or liable for any loss or damage you may suffer or incur in connection with such views, opinions, advice or assistance including in relation to their accuracy, truthfulness or completeness or for any acts, omissions, errors or defaults of any third party in connection with such views, opinions, advice or assistance.

4.5. We do not warrant that the Services or any materials on the Customer Website will meet all of your requirements or that they will be uninterrupted, timely, error free or secure.

Any material downloaded or otherwise obtained through the use of the Customer Website or the Services is done at your own discretion and risk and you are solely responsible for any damage to your device, corruption, or loss of data that results from the download of any such material.

4.6. No advice or information, whether oral or written, obtained by you from Us or through or from the Services or any materials on the Customer Website shall imply or otherwise create any warranty not expressly stated in these Terms of Use.

5. Changes to these Terms of Use

From time to time, We may change these Terms of Use. We will give you at least 28 days’ notice of any changes by email

6. How We will contact you

You agree that all communications between you and Us will be conducted electronically; this includes all notices, reports, documents, disclosures or other information that We are required to provide to you by law or as is reasonably necessary to provide the Services.

We may provide communications to you by one or more of the following methods: (1) email; (2) Customer Website; (3) text or picture message; or (4) any other method to the extent permissible by law.

7. Making an Enquiry or Complaint

7.1. We will always be fair and reasonable. Should there ever be an occasion when you feel that We have not provided you with a satisfactory level of service for Legal Assist, We would like you to contact us via hello@businessstack.pro.

We always do Our best to deal with any query promptly.

7.2. Once We have received the query, We will attempt to resolve it immediately. If this is not possible, We promise to acknowledge your query within 5 working days of receiving it. In the unlikely event that your query has not been resolved within 4 weeks of Our receiving it, We will write and let you know the reasons why, and what further action We will take.

7.3. Once We have resolved your query, We will confirm our response to you in writing by email.

7.4. If your complaint related to the Service you have received from a legal advisor after you have instructed them to act on your behalf and engaged with them directly, you should direct your complaint to the legal firm to be dealt with in accordance with the terms of your engagement with them including their complaints handling procedures. Although these complaints will be dealt with by the relevant legal firm, it is important to Us to monitor the quality of the legal advisors who We use as part of the Service so We would like to know if you are unhappy with the firm.

8. Third Party Rights

All third-party rights are excluded, and no third party shall have any right to enforce these Terms of Use.

9. Waiver

9.1. If We fail, at any time, to insist upon strict performance of any of your obligations under these Terms of Use, or if We fail to exercise any of the rights or remedies to which We are entitled under these Terms of Use, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

9.2. A waiver by Us of any default will not constitute a waiver of any subsequent default.

9.3. No waiver by Us of any of these Terms of Use will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

10. Severability

If any court or competent authority decides that any of the provisions of these Terms of Use are invalid, unlawful or unenforceable to any extent, the provision will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

11. Entire Agreement

These Terms of Use and any document expressly referred to in them constitute the whole agreement between Us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between Us relating to the subject matter of these Terms of Use.

12. Law and Jurisdiction

These Terms of Use, their subject matter and formation, will be governed by the Laws of England and Wales and you and We both agree that the courts of England and Wales will have exclusive jurisdiction.

If you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

13. Privacy Notice – How We Handle Your Personal Information

Who are we?

Lifestyle Services Group Limited trading as Assurant, a company registered in England (Company No: 5114385), located in Emerald Buildings, Westmere Drive, Crewe, CW1 6UN, is the controller of your personal data when you use Business Concierge Legal Assist and Tech Assist (the “Services”)

What information do we collect?

When you register for the Service or if you communicate with us via phone, email or social media we collect:

• Your full name

• Your contact details (telephone number, address, email address)

• Bank account and/or payment details

When you contact us directly about the Services, by phone, email or social media we may collect additional information about you or your devices, such as device information, the content of the message or any attachments you choose to provide to us.

How do we use your information?

We will only use your personal information for the following purposes

• To make our Services available to you and provide the Services which you have requested;

• To contact you, following your enquiry, reply to any questions or issues you have contacted us about;

• To process your required Services and take payment:

• To comply with any applicable laws or judicial or governmental requirements and the Terms & Conditions;

We will only process your personal information where we have a valid “legal basis”. These include:

• Performance of a contract. We need your personal information to provide you with the Services.

• Consent. You have consented to the use of your personal information

• Compliance with a Legal Obligation. Where we have a legal obligation to use your personal information, for example to comply with tax and accounting obligations.

• Our Legitimate Interest. Where we or a third party have a legitimate interest in using your personal information which overrides your interests and individual rights. We have a legitimate interest in using your personal information to respond to any comments or complaints you send us and otherwise to improve the safety, security, and performance of our Services. We only rely on our or a third party’s legitimate interests to process your personal information when these interests are not overridden by your rights and interests.

Who do we share your personal information with?

We share registration information with the Co-operative Bank plc who promoted the Services. We also contract third-party service provider and suppliers to deliver the Service, such as web site hosting parties and payment service providers. We may have to share your personal information with such third parties in order to allow for the provision of the service to you. They may only use your data for the exact purposes we specify. If we stop using their services, any of your data held by them will either be deleted or rendered anonymous.

International Data Transfers

In the context of the purposes described above, your Personal Data may be transferred outside the United Kingdom to countries that are not considered to ensure an adequate level of protection of personal data. We will ensure that appropriate Standard Contractual Clauses are in place for those countries with privacy laws that do not have adequate protection. We may also rely on Our vendor’s Binding Corporate Rules. Your privacy rights

You have the right to:

• Request what personal information we maintain about you and request that we update and correct inaccuracies in your personal information;

• Request for your personal information to be removed where we have no lawful basis for holding this information;

• Restrict or object to the processing of your personal information, have your information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your personal information to another company;

• Withdraw any consent you previously provided to us regarding the processing of your personal information. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent; and

You always have the right to lodge a complaint to the UK’s supervisory authority, the ICO however, we hope that you would consider raising any issue or complaint you have with us first.

How long do we keep your personal information?

We keep your personal information for a period of six years after we have completed performance of the Services or for as long as you are a customer unless we are required by law to keep the information for a longer period.

Information Security

We have implemented safeguards designed to protect your personal information in accordance with industry standards. We have measures in place to restrict access to personal information to those individuals who we know have a valid business purpose to have access to such data. We require those who provide services for us and to whom we provide personal information collected through the Services to keep such information secure and confidential. However, no method of transmission over the Internet or method of electronic storage is totally secure. Therefore, we cannot guarantee its absolute security.

Minimum age

We do not knowingly collect personal information from anyone under the age of 18. You must be at least 18 years of age to use the Services.

Changes to this Notice

We may update this Notice from time to time. If we make any changes to this Notice that affect you using our Services, we will notify you by email or by means of a notice through the Service, so that you may review the changes before you continue to use the Service. Please review changes carefully.
